Once you contact us relating to a clinical negligence claim we will do the following:
- Discuss with you what happened, what you consider went wrong and the impact it has had on yours and your family’s lives.
- Request medical records and details of the relevant examinations and treatment.
- Analyse records and take a full witness statement from the family regarding their version of events.
- Seek independent medical opinions to determine whether a mother or child’s injuries could and should have been prevented.
- If appropriate, attend a conference with a barrister and medical experts to discuss the strengths and weaknesses of a case,
- Make a decision, based on evidence gathered, as to whether we are in a position to bring a claim.
- Should admissions of negligence be made by the relevant Defendant, consider an application for interim payments to cover the cost of any immediate needs for a child and family including any suitable rehabilitation.
- Where appropriate, we seek to negotiate a settlement out of court which reflects the injury and loss caused, including damages to cover any future care, therapies, aids and equipment, medical treatment and appropriate accommodation.
